Người bán hoặc Creator trên nền tảng TikTok Shop tại Việt Nam nhận được thông báo/cảnh báo Vi phạm quyền Sở hữu trí tuệ (IPR) và cần thực hiện quy trình kháng cáo để tranh chấp kết luận này.

TikTok Shop thực thi chính sách bảo vệ quyền Sở hữu trí tuệ nghiêm ngặt. Khi nhận thông báo Vi phạm, người bán có thể kháng cáo qua Seller Center, còn Creator kháng cáo qua trang Account Standing. Quy trình kháng cáo phân biệt rõ giữa người bán và nhà sáng tạo về số lần kháng cáo và thời hạn: người bán được kháng cáo tối đa 2 lần (lần 1 trong 30 ngày kể từ ngày nhận thông báo, lần 2 trong 15 ngày kể từ khi bị từ chối lần 1); nhà sáng tạo chỉ được kháng cáo 1 lần trong 30 ngày. Có 9 loại vi phạm IPR cụ thể với yêu cầu tài liệu kháng cáo khác nhau: (1) Trademark Hàng giả (hàng giả nhãn hiệu) - cần Thư ủy quyền từ Chủ sở hữu nhãn hiệu/Nhà phân phối cấp 1, hoặc Chứng từ mua hàng trong 12 tháng gần nhất, hoặc Giấy chứng nhận nhãn hiệu từ cơ quan chính phủ/WIPO; (2) Trademark Wrong Association (liên kết nhãn hiệu sai) - cần Thư ủy quyền hoặc Giấy chứng nhận nhãn hiệu; (3) Trademark Over Use (sử dụng quá mức nhãn hiệu) - cần Thư ủy quyền; (4) Copyright Piracy (vi phạm bản quyền - hàng giả) - cần Thư ủy quyền từ Chủ sở hữu bản quyền hoặc Chứng từ mua hàng; (5) Copyright Unlawful Access (truy cập bản quyền trái phép) - cần Thư ủy quyền; (6) Copyright Unlawful Reproduction (sao chép bản quyền trái phép) - cần Thư ủy quyền, Chứng từ mua hàng, hoặc Chứng minh bán hàng/sử dụng trước; (7) Copyright Content Infringement (vi phạm bản quyền nội dung listing) - cần Thư ủy quyền, Chứng minh bán hàng/sử dụng trước, hoặc Minh họa sự khác biệt; (8) Design Infringement (vi phạm thiết kế đăng ký) - cần Thư ủy quyền từ Chủ sở hữu thiết kế hoặc Minh họa sự khác biệt (6 góc nhìn: trước, sau, trên, dưới, trái, phải) kèm tài liệu bổ sung; (9) Patent Infringement (vi phạm bằng sáng chế) - cần Thư ủy quyền từ Chủ sở hữu bằng sáng chế hoặc Minh họa sự khác biệt giải thích tại sao sản phẩm không vi phạm. Thư ủy quyền phải bao gồm: tên bên ủy quyền, tên bên được ủy quyền, quyền được ủy quyền, quốc gia ủy quyền, thời hạn ủy quyền, con dấu (nếu chủ sở hữu là tổ chức), chữ ký. Chứng từ mua hàng phải có: ngày mua, thông tin người bán, thông tin người mua, thông tin sản phẩm, giá. Giấy chứng nhận nhãn hiệu phải có: thông tin nhãn hiệu, quốc gia cấp, tên chủ sở hữu, thời hạn hiệu lực, phân loại nhãn hiệu. Kết quả kháng cáo thành công: TikTok Shop gỡ bỏ hình phạt và khôi phục quyền lợi; thất bại: duy trì hình phạt. 5 lý do phổ biến bị từ chối: Thiếu tài liệu hỗ trợ, Từ chối ban đầu hợp lệ, Tài liệu không rõ ràng, Tài liệu không hợp lệ, Tài liệu không liên quan.

Hành động

Đối với người bán: Đăng nhập TikTok Shop Seller Center → Chọn thẻ “Shop Health” → vào “Vi phạm Records” → Nhấn “Appeal” để nộp kháng cáo → Theo dõi trạng thái qua “Appeal Details”. Đối với Creator: Đăng nhập trang Account Standing → Chọn thẻ “Account Standing” → vào “Violation Details” → Nhấn “Appeal” → Theo dõi qua “Appeal Details”. Chuẩn bị tài liệu kháng cáo phù hợp với loại vi phạm cụ thể: đảm bảo đầy đủ các thông tin bắt buộc theo mẫu, nộp đúng thời hạn (30 ngày cho lần 1 đối với người bán, 30 ngày duy nhất cho nhà sáng tạo). Nếu không chắc chắn về quy định pháp luật Sở hữu trí tuệ địa phương, nên tìm kiếm tư vấn pháp lý chuyên nghiệp. The protection of others’ intellectual property rights is a critical factor in keeping our platform secure. As a result, we take action against sellers or creators who breach our TikTok Shop Intellectual Property Policy and related guidelines.If you receive a notice or warning of infringement and believe the rights owner or TikTok Shop made an error, you may appeal or dispute the claim by raising a ticket/appeal in the Seller Center.The Appeal ProcessIt is important to note that the appeal process and timeline differ depending on if you are a seller or creator.For SellersPlease login to your TikTok Shop Seller CenterClick on the “Shop Health” tab and navigate to the “Violation Records” tab Click on the “Appeal” button to file an appeal Once done, you can click on “Appeal Details” to monitor the status of your appealFor each violation, sellers can file up to two appeals.The first appeal must be filed within thirty (30) calendar days from the date the violation notification was issued.The second appeal must be filed within fifteen (15) calendar days after the rejection of the first appeal.For CreatorsPlease login to your TikTok Shop Account Standing page. The guidelines below sets out the supporting documents that sellers or creators must provide during an appeal for different types of alleged intellectual property rights violations.Please ensure that you submit the relevant supporting documents that correspond to your alleged violation type. Trademark Counterfeit This violation type occurs when the listed product is alleged to infringe on another’s trademark rights as it involves the sale or promotion of counterfeit products. To appeal a counterfeit product violation, you need to submit one of the document types listed here. Letter of Authorisation from the Trademark Owner or Level 1 Distributor. It should include the following information:Name of authorising partyName of authorised partyAuthorised rights (rights to use trademark for the complained products / rights to sell or promote the complained products) Authorised countryAuthorisation periodStamp of the authorising party (if the IPR Owner is a corporate entity)Signature of the IPR Owner (or representative if the IPR Owner is a corporate entity)Proof of Purchase (either a receipt or invoice) from the Brand Principal or Internationally recognised wholesale/Retailer with legitimate sources issued within the last 12 months.
